Mississippi cottage food rules in plain English

This is general information, not legal advice. Check your state and local rules. Last reviewed Oct. 13, 2026.

What it is

A cottage food operation makes nonpotentially hazardous foods in the kitchen of the operator's private home, owned or rented, and sells them directly to the end consumer.

Source

License or permit

None. A cottage food operation that follows the law and stays under the sales cap is exempt from the state food permit. The Mississippi State Department of Health may inspect only after a complaint.

Source

Sales cap

$35,000 in gross annual sales of cottage food products, counting all sales at every location.

Source

How you can sell

Directly from the producer to the end consumer. Sales over the internet, by mail order, at wholesale or to stores are not allowed. Advertising online, including on social media, is allowed.

Source

Shipping out of state

Not allowed. The law bans mail-order sales, and MSDH says cottage foods may be sold only in Mississippi.

Labels

Every product must be prepackaged and labeled with the operation's name and address, the product name, ingredients in descending order by weight, net weight or volume, allergen information, and this statement in at least 10-point type: Made in a cottage food operation that is not subject to Mississippi's food safety regulations.
